I.   PRIVACY STATEMENT

This data privacy statement has been prepared to better serve any individual who avails himself of any of the products, and services of FELCO herein referred to as the data subject. This can be explained by informing them on how their personal data are being collected, used, and secured by FELCO

Please read FELCO Website Data Privacy Statement carefully to get a clear understanding of how the company uses, protects, or otherwise handles your personal data in accordance with Republic Act No. 10173, or the Data Privacy Act of 2012, and its Implementing Rules and Regulations (collectively, the “Data Privacy Act”).

 

II.  FELCO’s DATA PRIVACY NOTICE FOR PROCESSING ORDERS, INQUIRIES, AND REQUESTS

 

A. WHAT TYPE OF INFORMATION WE COLLECT

FELCO collects the information you directly provide when sending an inquiry, concern, customer support, or consulting for a project at the FELCO website. The following personal data will be collected:

Promos

4. Other information depending on the promo type

We also collect information when you voluntarily complete customer surveys, provide feedback, join marketing promotions including related activities, and participate in competitions or contests.

 

B. WHY WE COLLECT PERSONAL INFORMATION

To improve our products and services, it is important that we collect, use, and process your personal information when it is reasonable and necessary. All data collected will be used in processing your inquiries or concerns sent through the FELCO website. 

In particular, we are using your information to:

1. Manage your account, provide customer care activities, monitor the quality and security of the network, train our staff, and provide services timely and efficiently and ensure your fair and lawful use of the products and services provided by FELCO;
2. Send commercial and promotional advertisements, loyalty and rewards offers, surveys, customer care and aftersales communications, and other broadcast push messages;
3. Share your personal data with third-party content providers or other third-party services for which you sign up;
4. Conduct analysis for research and marketing initiatives, including the generation of anonymized or non-personally identifiable location and mobility data to show footfall, location patterns, crowd density, and other information that may be relevant for marketing purposes;

 

C. HOW WE USE/PROCESS YOUR PERSONAL DATA

FELCO will only use and process collected personal data for the following purposes:

1. To process customer orders necessary in the fulfillment of the service.
2. To establish customer relationships and communicate product or delivery concerns, if necessary.
3. To provide, develop, implement, and manage services for you, including customer marketing materials and customer satisfaction surveys that help us enhance our services.
4. To provide timely, reliable, and value-added services to customers, including enhancements on our platform, shipment tracking, account management, and billing, logistics management, information management, technical support, e-commerce, and related services;
5. Other purposes directly relating to any of the above.

At all times, your personal data shall not be used or processed for any purpose that is contrary to law, morals, or public policy

 

D. WHO WE SHARE YOUR INFORMATION 

As a general rule, we are not allowed to share your data with a third party except in limited circumstances as noted below. 

By giving your consent, you authorize FELCO to share your personal data among its entities, accredited/affiliated or independent/non-affiliated third parties, whether local or foreign as necessary for the proper execution of the processes related and limited only to the declared purpose in this data privacy statement. 

All third parties with which we share this personal data are required to use your personal data in a manner that is consistent with this data privacy statement and may not be used for other purposes. If and when it becomes necessary, a data-sharing agreement shall cover any sharing of data between and among FELCO and/or its third-party partners.

FELCO may also share information in accordance with any order from any relevant government agency as provided by law.

 

E. WHERE WE STORE AND PROTECT YOUR PERSONAL DATA

FELCO shall exert effort in securing your data in both its physical and digital form. You can access your data anytime by signing in to your account. Your personal data will be stored in the FELCO website database as long as your account is active and shall be deleted immediately upon request. Based on FELCO Data Privacy Manual, you may request deletion or file any complaints to dpo@fireflyelectric.com. The concerned department or section shall confirm with the complainant its receipt of the complaint. If the data subject’s consent is to be given following a request by electronic means, the request must be clear, concise, and not unnecessarily disruptive to the use of the service for which it is provided. 

In special cases and in accordance with the law, lawful heirs may invoke the rights of the data subject.

 

F. OUR PROTECTION MEASURES

Only authorized FELCO personnel have access to this personal information, the exchange of which will be facilitated through email and hard copy. They will be stored in a secured database for a specific period of time (or after inquiries, and requests are acted upon) after which physical records shall be disposed of through shredding, while digital files shall be anonymized.

 

G. ACCESS AND CORRECTION

You have the right to ask for a copy of any personal information we hold about you, as well as to ask for it to be corrected if you think it is wrong. FELCO may also change this Data Privacy Statement from time to time. If FELCO makes any significant change in the collection, use, and protection of personal data, FELCO will provide you notice through the FELCO Website or by some other means, such as email. It is encouraged that you periodically review the Data Privacy Statement posted on the  FELCO Website for the latest information.

 

H. WHAT HAPPENS WHEN THERE ARE CHANGES IN THIS POLICY

FELCO may change this Data Privacy Policy from time to time. If FELCO makes any significant change in the collection, use, and protection of personal data, FELCO will provide you notice through the FELCO Website or by some other means, such as email. It is encouraged that you periodically review the Data Privacy Statement posted on the  FELCO Website for the latest information.
